Empire State of Minding the Minors: New York Laws Aim To Ensure Children's Privacy and Online Safety

On June 20, 2024, New York passed two pivotal bills aimed at protecting children online: the Stop Addictive Feeds Exploitation (SAFE) for Kids Act and the New York Child Data Protection Act (CDPA). The SAFE Act restricts social media platforms from providing "addictive feeds" to minors under 18 without parental consent, while the CDPA limits how online operators can handle the personal data of minors aged 13 to 17. These laws impose strict regulations on how companies can interact with and protect children online, with enforcement led by the New York Attorney General.

### Key Provisions of the SAFE Act

- **Addictive Feeds**: Prohibits social media platforms from providing content algorithms designed to increase user engagement without parental consent for users under 18.

- **Overnight Notifications**: Bars notifications from being sent between midnight and 6 AM unless parental consent is obtained.

- **Age Verification**: Requires platforms to verify the age of users to ensure compliance.

### Key Provisions of the CDPA

- **Informed Consent**: Requires operators to obtain informed consent from minors aged 13-17 before processing their data, and parental consent for those under 13.

- **Data Deletion**: Mandates deletion of a minor’s data within 30 days if informed consent is not obtained.

- **Processor Contracts**: Imposes strict requirements for third-party data processors to ensure compliance with data protection rules.

### Enforcement and Impact

The Attorney General holds exclusive enforcement power, including the authority to impose penalties up to $5,000 per violation. Businesses are urged to review these new regulations closely, as they could face significant legal challenges and financial penalties for non-compliance.
